What is the legal validity of an electronic signature?
Electronic signatures are described in several standards, including Article 10 § 2 of Provisional Measure No. 2,200-2/2001, which established the Brazilian Public Key Infrastructure, known as ICP-Brazil. See an excerpt below:
“The provisions of this Provisional Measure do not prevent the use of other means of verifying the authorship and integrity of documents in electronic form, including those using certificates not issued by ICP-Brazil, provided that they are accepted by the parties as valid or accepted by the person to whom the document is opposed.”
This means that digital certificates are one of the methods for verifying authorship and integrity - but they are not the only ones. Another legally valid means is private certification, provided that it is accepted by the signatory parties.
