The electronic signature - or digital* - is an agile, secure and auditable electronic record that makes it possible to identify and certify the authorship of the event, in addition to ensuring that the content of the signed document is not modified after the signatures are finalized.
*The terms digital signature and electronic signature are synonymous. Legislation does not differentiate them as different types of signatures.
As an electronic document signature platform, Clicksign is part of the ICP-Brazil ecosystem, as it allows the authentication of the signer through a Digital Certificate whose issuers are accredited by ICP-Brazil. In addition, every document signed on the platform has the Clicksign ICP-Brazil Digital Certificate, one of the security factors to ensure that the signed document was not modified after its finalization.
In Brazil, electronic signatures are regulated by Provisional Measure No. 2,200-2/2001 And by Law no. 14.063/2020. There are also legal provisions and regulations in Law No. 10,406/2002 (Civil Code), Law No. 13,105/2015 (Code of Civil Procedure) and Law No. 14,382/2022 (Electronic System of Public Records Act), in addition to specific regulations depending on the nature of the signed document.

Brazilian law classifies electronic signatures according to the authentication methods used to authenticate the signers of a document:
Electronic signature qualified: It is the one carried out using an ICP-Brazil Digital Certificate.
Electronic signature advanced: It is the one performed with authentication methods that can uniquely identify the signer.
Electronic signature unsophisticated: it is performed with simpler methods of authenticating the signer, such as an e-mail and/or a computer's IP, for example.

It is important that you verify that the legislation mandates the use of a specific type of electronic signature for certain situations.

After the subscriptions are finalized, it is possible to carry out the Download of the documents signed on the Platform, which will remain legally valid and can be verified using the tool provided by Clicksign called Validator. Through the Validator, it is possible to verify the integrity of the document signed on the Platform, that is, that the signed document was not changed after its signature and that it was, in fact, signed on the Clicksign Platform. If the document to be verified was signed more than twelve months ago, before the validation process, the Clicksign Digital Certificate must be renewed, through the Validator itself. If the account on the Platform is closed, Clicksign will delete, after notifying the customer, the contact book data and the documents uploaded to the Platform, which does not affect the validity and integrity of existing documents.
In the same way as in the case of a physical signature, it is the responsibility of the parties to provide valid and true data for the proper authentication of the Signatories. It is important for the User to verify the veracity and accuracy of the Signators' data entered on the Platform to ensure that the document can generate the expected legal effects.
Clicksign is a platform that allows the creation of any type of electronic signature required by law, in a convenient and secure manner and with legal validity.
In the signature process, Clicksign's role is (i) to collect and record in the document to be signed, the signers' authentication methods, selected by the document owner and confirmed by the signers; and (ii) to ensure that the content of the signed document is not modified after the signatures are finalized.
For the signatures made on the platform to have legal validity, the User must identify the signers by observing the veracity, appropriateness and accuracy of the data, in addition to selecting the authentication methods according to the intended purpose.
The expression of will of a legal entity is formalized through one or more individuals, in accordance with the established powers of each one. For this reason, we recommend that the documents be signed by individuals.
Like any expression of will, accept it via WhatsApp is one of the ways offered on the Platform for concluding an agreement. It is up to the user to verify that the signer's authentication methods used for Accepting via Whatsapp meet the intended purpose, in accordance with current legislation.
